  1. General

These terms and conditions apply to Oldboy's Flowers Gift Cards purchased at www.oldboysflowers.com.au.

By purchasing, using or accepting Gift Cards you accept these terms and conditions (“Terms and Conditions”). 

Oldboy's Flowers reserves the right to interpret, modify, change or terminate the Terms and Conditions without notice, from time to time at our sole discretion. The most recent Terms and Conditions will always be posted at www.oldboysflowers.com.au.   

  1. Validity

Each purchase of Gift Cards is limited to a maximum value of $250.00. The minimum value for Gift Cards is $25.00.

The Gift Cards can be used until the balance of the card is zero. If the balance of the card is zero for three months, the Gift Card is invalid and cannot be activated or used again.

Gift Cards may only be purchased by residents of Australia.

Once a Gift Card has been issued, no activation fees, account keeping fees, balance enquiry fees apply. Oldboy’s Flowers reserves the right to charge fees as part of a sale to cover the cost of processing a payment such as:

  • overseas transaction fees
  • booking fees
  • payment surcharge fees
  • fees charged for the reissue of a lost, stolen or damaged card.

The Gift Cards may not be resold in any manner whatsoever by a person, without the express written permission of Oldboy’s Flowers.

You agree that the laws of Australia, without regard to principles of conflict of laws, will govern these Terms and Conditions and any dispute that may arise between you and Oldboy's Flowers. All Terms and Conditions are applicable to the extent permitted by law. If any of these terms and conditions are deemed invalid, void, or for any reason unenforceable, that unenforceable term will be deemed severable and will not affect the validity and enforceability of any remaining terms and conditions.

  1. Using a Gift Card

You must present a Physical Gift Card or an eGift Card e-mail with barcode or other valid barcode either printed or on your mobile device to redeem in-store.

The Gift Cards may not be used towards the purchase of any gift certificates or gift cards. 

Oldboy's Flowers reserves the right, without notice to you, to void Gift Cards without a refund, suspend or terminate customer accounts, suspend or terminate the ability to use our services, cancel or limit orders, and bill alternative forms of payment if we suspect that a Gift Card is obtained, used, or applied to an Oldboy's Flowers account fraudulently, unlawfully, or otherwise in violation of these Terms and Conditions.

If you used a Gift Card together with another payment method, a refund to the Gift Card will be issued in priority of a refund to other payment methods.

  1. Delivery of Gift Card

If you have purchased a physical Gift Card through our website, www.oldboysflowers.com.au, you or the designated recipient will receive the Gift Card within 1-5 business days from the date of purchase.

If you purchase an eGift Card it will be sent to the recipient’s email address immediately after the purchase is completed.

Oldboy's Flowers will not be liable for any failure or delay in delivery of a Gift Card. You are obligated to provide a valid address for delivery of the Gift Card. If you order an e-Gift Card you are obligated to provide a valid email address for delivery. If the address you have provided cannot be confirmed, Oldboy's Flowers reserves the right to withhold the delivery of the Gift Cards.

  1. Exclusions

Gift Cards are not refundable or redeemable for cash except as required by law. Void where prohibited or restricted by law. Gift Cards may be used at select Oldboy’s Flowers operated and branded locations and online at www.oldboysflowers.com.au. You can use the Gift Cards to pay for the full value or part of the value of your selected item(s).

  1. Expiry Date

Expiration dates apply to Gift Cards, which is three years commencing from the date the Gift Card is first issued to a customer (the “Expiry Date’). A customer is required to use all of the balance of the Gift Card before the Expiry Date of that Gift Card.

The Expiry will be displayed on the Gift Card or eGift Card as either the full date or as a period of time. If the Expiry Date is shown as a period of time the date the Gift Card was supplied or purchased will be displayed on the Gift Card or eGift Card so that the Expiry Date can be determined.

 

  1. Transaction Enquiries

The unused value of a Gift Card may be checked online at www.oldboysflowers.com.au or by the holder contacting Oldboy’s Flowers at the email address or phone number set out in clause 1.

  1. Lost and Stolen Gift Cards

Oldboy's Flowers cannot be held liable for Gift Cards once activated, which subsequently are lost, stolen, inactivated or damaged. Treat your Gift Cards as cash.

A Gift Card will not be reissued unless the Holder proves to the reasonable satisfaction of Oldboy’s Flowers that:

  • the Gift Card is faulty or damaged due to the fault of Oldboy’s Flowers; or
  • Oldboy’s Flowers has acted in contravention of any condition or warranty under the Australian Securities & Investments Commission Act 2001 (Cth) or any other applicable laws.
  1. Liability

TO THE FULL EXTENT PERMISSIBLE BY LAW, WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO GIFT CARDS, INCLUDING WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. TO THE FULL EXTENT PERMISSIBLE BY LAW, IN THE EVENT A GIFT CARD IS NON-FUNCTIONAL, YOUR SOLE REMEDY, AND OUR SOLE LIABILITY, WILL BE THE REPLACEMENT OF THAT GIFT CARD.

  1. Privacy

We reserve the right to require additional verification of your identity, Gift Card or account ownership, or provision of an additional payment instrument, before you are able to apply a Gift Card to your account or to a purchase.

  1. Promotion Activities

The Holder of a Gift Card must not use a Gift Card in connection with any marketing, promotion or advertising campaigns without prior written express permission of Oldboy’s Flowers.

  1. Disputes

Any dispute or claim relating in any way to Gift Cards will be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify. WE AND YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED OR REPRESENTATIVE ACTION. If for any reason a claim proceeds in court rather than in arbitration, we each waive any right to a jury trial. We and you also agree that you or we may bring suit in court to enjoin infringement or other misuse of intellectual property rights.
